Pay and conditions circular on contractual continuity of service


Following latest advice from the Department of Health, pay circular (AforC) 3/2016 provides employers with guidance on using their discretion to take relevant non-NHS experience into account, for example, when calculating annual leave entitlement.

Agenda for Change allows employers to take into account previous service, inside and outside the NHS, when calculating an employee’s entitlement to annual leave. Relevant experience outside the NHS may include previous employment abroad, including in the health services of other member states of the European Union.

The NHS Staff Council has agreed a new question and answer which is incorporated into Section 12 of the Terms and Conditions of Service Handbook and Annex 28: Guidance on frequently asked questions (FAQs) (England and Wales*1), and Annex 28: Guidance on FAQs (Scotland and Northern Ireland).
