Read our response to the Department of Health's recent consultation on draft regulations which prevent employers discriminating against individuals who have made a protected disclosure.

Key points include:

  • employers welcome an open, responsive and learning culture
  • changes in employment practice and behaviours are unlikely to be driven by adding further regulations
  • focus needs to be on supporting employers to minimise the risk of entering into employment tribunals
  • staff, family and public confidence in the protection requires a system wide approach across both health and social care.
You can read the full consultation Employment Rights Act 1996 (NHS Recruitment – Protected Disclosure) Regulations on the DH website
